Ernest DominguezThough he pleaded no contest Friday to molesting four students, former Santa Fe elementary school teacher Ernest Dominguez maintained his innocence to the end.

"To all the families who have claimed to have suffered irreparably — I've suffered as much as these kids have," Dominguez told a state district judge. "My demise was having a strict academic classroom."

Dominguez, 35, maintained he was speaking "for every teacher out there" when he said that any person in a position of authority can be brought down when they are accused of something.

"And when a child makes the accusation, 90 percent of the time people will believe the child," he said. "I stand before you maintaining my innocence."

Despite that proclamation, Dominguez pleaded no contest to four counts of criminal sexual contact of a minor. In exchange for the plea deal — which Judge Stephen Pfeffer thought twice about before accepting the agreement — Dominguez will be on probation for up to 20 years, have to register as a sex offender and won't be allowed to be around children, the mentally ill or the elderly.

Grey NevelosFormer Estancia winning track coach Grey Nevelos pleaded guilty to contributing to the delinquency of a minor, a fourth degree felony and one of six counts he was charged with, at a pre-trial conference at Estancia District Court on Oct. 2.

“(Nevelos) did knowingly and intentionally engage in a course of conduct, including the offering of alcoholic beverages, the touching of (the first victim’s) unclothed buttocks under the pretext of treating a lower back injury, the engaging or attempting to engage her in graphic conversations concerning any sexual activities that she may have engaged in, commenting on his sexual prowess with specific reference to her perceived needs by way of invitation to join him in such activities” and asking her to his home by offering massages, alcohol and showing videos, the seconded amended criminal information states.

Nevelos wore a grey suit and light blue dress shirt, and was seated next to his attorney, Michael Alarid. He signed the plea agreement on August 20.
Judge Edmund Kase III ordered a 60-day diagnostic evaluation prior to sentencing “to understand what may have led to this and to better impose an appropriate sentence.”

Nevelos must report to the Torrance County Sheriff’s office by 10 a.m. on Oct. 6 to be transported to Los Lunas for the evaluation. Kase asked Nevelos whether he understood the agreement he had signed meant he would never again be a coach or a teacher, what might happen at a trial and that he might not have to testify, and that the jury might find him not guilty.

James CruiseA former coach at Alamogordo High School has pleaded guilty to charges of having sex with one of his student athletes in March.

James Javier Cruz, 29, who coached girls soccer and basketball and was also an employee of the Alamogordo Family Recreational Center, pleaded guilty last Tuesday to three counts of having sex with the 16-year-old girl.

Cruz faces up to four and a half years in prison and fines of up to $15,000. He remains free on a $40,000 bond. A date for sentencing has not been scheduled.

Chief Deputy District Attorney RoxeAnne B. Esquibel said the plea bargain means the victim won't have to testify in court. A jury trial for Cruz was scheduled to begin Monday. Cruz's attorney, Bert Atkins, declined to comment on the case.

Cruz was arrested in April on five counts of criminal sexual penetration of a minor and three counts of contributing to the delinquency of a minor. In the plea deal, five of those charges were dismissed, including three counts of contributing to the delinquency of a minor and two counts of having sex with a minor.

The charges allege Cruz picked the girl up at Alamogordo High School before her fourth period class began and took her to his mother's apartment where they had sex.

Marcelito Creer, an elementary teacher for the Bureau of Indian Affairs working at Choosgai School in Tohatchi, New Mexico has been arrested on sex abuse charges after an 8-year-old boy was allegedly improperly touched at a Tohatchi community function.

Ron Saavedra, an investigator for the McKinley County Sheriff’s Department, said the boy’s family reported that he was molested by Creer during an overnight party for children within the Tohatchi community on May 25. Creer was considered a family friend of the victim and is employed with the Choosgai School.

The boy reportedly told his family what happened and the community was informed of the allegations during a meeting in Tohatchi. Creer reportedly admitted to some of the allegations and offered to pay the family for counseling, The alleged victim, his family and Creer relocated to New Mexico from the Philippines.

A man accused of soliciting a child online while he was a Sunland Park Elementary School teacher has accepted a plea deal in the case.

Dominic Ebert of Santa Teresa pleaded guilty Monday to a fourth-degree felony charge of child solicitation by computer.

The Las Cruces Sun-News reports a sentencing date has not been set by state District Judge Doug Driggers.

Authorities say Ebert, in a series of e-mail exchanges, asked a state attorney general's agent posing as a 12-year-old girl to perform a sex act. Ebert, 38, was arrested last April 1, and his contract with the Gadsden public school district was not renewed when it expired the following month.

long time track coach in Estancia was arrested Friday and charged with sex crimes against two of his female athletes.

Grey Nevelos, 56, is accused of inappropriately touching two girls while they were nude and offering them alcohol. The crimes are alleged to have happened in 2006 and 2007.

The school put Nevelos on leave in 2007, but he was formally charged on Friday.

Nevelos spent two decades as coach of a successful cross country program at Estancia High School.

Duriel Martin

A former Alamogordo High School coach who pleaded guilty to criminal sexual contact of a minor has been sentenced to a year in prison.

Duriel Martin was sentenced Friday by state District Judges James Waylon Counts. He will be required to register as a sex offender.

Martin was accused of entering the home of a 17-year-old Alamogordo High School student through an unlocked window early September 21st, 2006, and forcibly touching her.

Martin was arrested six days later and was indicted by a grand jury last October 24th. He entered his plea last July 23rd.

School officials have said Martin was a part-time junior varsity boys’ basketball coach during the 2005-2006 season.

A substitute teacher who is an admitted pedophile and is wanted for secretly videotaping the legs of female elementary school students has been found in Colorado.

Robert H. Ashley, who had been been considered a fugitive since deputies tried to arrest him Monday, was picked up at about 1:30 a.m. by Montrose County, Colorado deputies. The U.S. Marshals Service and the Bernalillo County Sheriff's Office, in a joint news conference this morning, announced that they were aware that Ashley had initially gone from New Mexico to Arizona, but then officials lost track of him for about 24 hours.

A Colorado-based informant on Wednesday night tipped the U.S. Marshals Service that Ashley was staying in a motel in Montrose County.  Deputies surveilled him for about an hour before taking him into custody.

Police are releasing more details about a former teacher they believe used a hidden camera to look up girls' skirts. Investigators on Tuesday looked through photos on a video camera belonging to Christopher Lucero, 25. They believe he put a tiny camera on his shoe and connected it to a camera on his waist.

On the camera, police say they found 11 video clips. Some contained images of girls between 10 and 17 years old at Cliff's Amusement Park in northeast Albuquerque. According to a criminal complaint, Lucero had positioned himself in a way to videotape under a 17-year-old's skirt. Police say they have video of Lucero possibly testing the camera before going to Cliff's Amusement Park, where he was caught. "The other we have was apparently of a mall, but there was no action where it fell under the purview of voyeurism," said Albuquerque police spokesperson John Walsh. "In other words, there were no victims found there. It was just him walking around in what was obviously a mall setting."
